Welcome to Earthonomy. These Terms of Service ("Terms") govern your access to and use of the Earthonomy website, platform, and services including RISE™ certifications, SDL™ data platform, and Earthonomy Learn™ training programs. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using Earthonomy's services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Services
Earthonomy provides sustainability assessment, certification, and data management services including:
- RISE™ Certification Program — Sustainability maturity assessment and third-party validated certification
- SDL™ (Sustainability Data Lakehouse) — Enterprise data platform for ESG compliance and reporting
- Earthonomy Learn™ — Training and educational programs for sustainability professionals
- Sofia™ AI Assistant — AI-powered guidance for sustainability transformation
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.
3. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and account credentials
- Promptly notify us of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for extended periods.
4. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose or in violation of any applicable laws
- Submit false, misleading, or fraudulent information in assessments or certifications
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our services
- Copy, modify, or distribute our proprietary content without authorization
- Use automated systems (bots, scrapers) without our written permission
- Misrepresent certification status or use Earthonomy trademarks without authorization
5. Intellectual Property
All content, features, and functionality of Earthonomy services, including but not limited to the REA™ (Regenerative Economy Architecture) framework, Seven Forces methodology, assessment tools, software, text, graphics, logos, and trademarks are owned by Earthonomy, LLC and are protected by intellectual property laws.
You may not use, reproduce, distribute, or create derivative works from our intellectual property without our express written consent.
Your use of our services does not grant you any ownership rights in our intellectual property.
6. Certification Terms
Organizations pursuing RISE™ certification agree to:
- Provide accurate and truthful information throughout the assessment process
- Cooperate with validators and provide access to requested documentation
- Maintain practices consistent with their certified level during the certification period
- Notify Earthonomy of any material changes that may affect certification status
- Use certification marks and designations only as authorized by Earthonomy
Earthonomy reserves the right to revoke, suspend, or downgrade certifications for non-compliance, misrepresentation, or failure to maintain certified practices.
7. Payment Terms
Certain services require payment. You agree to:
- Pay all fees according to the pricing and payment terms in effect at the time of purchase
- Provide valid payment information and authorize recurring charges for subscription services
- Pay any applicable taxes, duties, or other governmental assessments
Fees are non-refundable except as expressly stated in our refund policy or required by law. We reserve the right to modify pricing with reasonable notice.
8. Confidentiality
We recognize that assessment data and organizational information may be confidential. We commit to:
- Protecting your confidential information using appropriate security measures
- Using your data only for the purposes described in our Privacy Policy
- Not disclosing your confidential information except as required for service delivery or by law
Aggregated, anonymized data may be used for benchmarking and industry insights without identifying specific organizations.
9. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that our services will be uninterrupted, error-free, or secure, or that defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by law, Earthonomy and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or relating to your use of our services.
Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid to Earthonomy in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Earthonomy and its affiliates, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users or third parties, or is otherwise objectionable.
Upon termination, your right to use our services will cease immediately. Provisions that by their nature should survive termination shall survive.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where appropriate, by email. Your continued use of our services after changes take effect constitutes your acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
